imdeadgirl Terms of Use

Summary (the full Terms below control):
- imdeadgirl helps you plan your funeral, write your obituary and letters, and share them with the people you choose after you die.
- It is not a will, not estate planning and not legally binding.
- You must be 18+ and in the US.
- Plans renew every year until you cancel. You can cancel anytime.
- If you stop answering check-ins for 3 days, we contact the people on your list. One of them can confirm your death, and then your information is released to them.
- You can download all of your information at any time.
These Terms of Use ("Terms") are an agreement between you and 3BSI LLC, a Michigan limited liability company ("imdeadgirl," "we," "us"), and govern your use of imdeadgirl.com, our apps, emails and text messages (the "Service"). By creating an account or using the Service, you agree to these Terms, our Privacy Policy and, if you receive text messages from us, our SMS Terms.
These Terms contain a binding arbitration agreement and class-action waiver (Section 17), which affect how disputes are resolved. You may opt out within 30 days.
1. What imdeadgirl is
imdeadgirl lets you record wishes for your funeral and celebration of life, write your own obituary, upload photos, write letters to specific people, and choose people ("Your People") who will receive access to that information after your death.
2. Eligibility
You must be at least 18 years old, a resident of the United States, and able to form a binding contract. Any mobile number you give us must be a US number. You may only create an account for yourself. You may not create an account in another person's name.
3. Not estate planning, not legal advice
imdeadgirl is not a will, trust, advance directive, power of attorney, or any other legal document, and nothing you enter is legally binding. We do not distribute property, money or assets, and the Service is not designed to record instructions about them. Your funeral and celebration wishes are suggestions to the people you love. They may not be able, or legally permitted, to carry them out.
The Service does not provide legal, financial, medical, mental-health, funeral-industry or tax advice. For estate planning, talk to a licensed attorney.
If you are having thoughts of suicide or self-harm, call or text 988 (Suicide & Crisis Lifeline) or call 911. imdeadgirl is not a crisis service.
4. Your account
- You may sign in with Google, Apple, Facebook, or email. You are responsible for keeping your login methods secure and for activity on your account.
- You must give accurate information, including your name and any mobile number you give us, and keep it current.
- Tell us right away at support@imdeadgirl.com if you believe your account has been compromised.
5. Identity verification
We may require you to verify your account by linking a Google, Apple or Facebook account before you can add people to your list or address letters. When you link one, your full name on imdeadgirl comes from that account and can't be edited afterward. We receive only your name, email address and an account identifier from it; we don't post on your behalf or see your contacts. If we require verification and you don't complete it, your information will never be released to anyone.
6. Plans, payment and automatic renewal
Plans. We offer annual plans only. Current plans and prices are shown on our pricing page and at checkout, and those prices control. As of the effective date:
- Basic: $1 per year.
- Bougie: $2 per year.
- Extras (Bougie only): $3 per year each; each adds 100 photos and 10 letters.
- Video messages (Bougie only): $5 per year for each block of 10 letters (one block with Bougie, plus one per Extra).
Prices are in US dollars and exclude applicable taxes. There is no free plan and no lifetime plan.
Automatic renewal. Your plan automatically renews every year at the then-current price, and we will charge your payment method on file unless you cancel before the renewal date. We will email you a reminder between 15 and 45 days before each annual renewal, stating the renewal date, the amount and how to cancel. You can cancel anytime in Settings → Plan & billing or through the Stripe customer portal. Cancellation takes effect at the end of the current paid year.
Payments. Payments are processed by Stripe, Inc. We do not store your full card number.
Refunds. Except where required by law or as stated in Section 13, fees are non-refundable, including for partial years. If you believe you were charged in error, contact support@imdeadgirl.com within 60 days of the charge and we will review it.
Upgrades and downgrades. Upgrades take effect immediately and are prorated. Downgrades take effect at your next renewal, and only if your content fits within the lower plan's limits.
Price changes. We may change prices with at least 30 days' notice before your next renewal. If you don't agree, you can cancel before the new price applies.
Failed payments and lapse. If a payment fails and is not resolved, your plan lapses. While lapsed, your account is read-only, check-ins stop, and nothing will be released to Your People. You can still download your information. If your account remains lapsed for 12 months, we will notify you 30 and 7 days before deleting it, and then delete it.
After release. When your information is released after your death, we pause billing and stop charging your payment method.
7. Promo codes
Promo codes are subject to the terms stated with them, may expire, have no cash value, and may not be transferred or sold. A code for a free or discounted period may not require a payment method upfront. If you do not add one, your plan will lapse at the end of that period. We may void codes that were obtained or used fraudulently.
8. Your content
"Your Content" means everything you add: plans, obituary, letters, photos, the names and contact details of Your People and recipients, and notes.
- You own Your Content. You grant us a limited, non-exclusive, royalty-free license to host, store, copy, process, encrypt, transmit and display Your Content only to operate and provide the Service to you and the people you choose, including generating your funeral program and exports. We do not use Your Content for advertising and do not sell it.
- You confirm that you have the right to upload Your Content, including photos of other people, and that it does not violate anyone's rights.
- About other people. When you add someone to Your People or as a letter recipient, you confirm that you are entitled to share their name and contact details with us for this purpose.
9. Check-ins, death confirmation and release
The Service sends you check-ins by email and text. You confirm you're alive by tapping "I'm not dead yet, girl" or by logging in.
How release works. You acknowledge and agree to the following:
- If you do not respond to a check-in within 3 days, or if someone reports your death and you do not respond within 3 days, we email (and, where available, text) the people on Your People list and ask whether you have died.
- A single "Yes" from any one person on your list is enough to release your information. We do not independently verify deaths. We do not obtain death certificates, and we do not check government or other death records.
- On release, the people on your list get access to the sections you chose for them, and letter recipients get access to their letters. Access lasts one year, and then your information is permanently deleted.
- If you check in after a release, we revoke all access as quickly as practical. We cannot recall anything that was already viewed, copied, printed, downloaded or shared.
- If your list is empty, or we required you to verify your account and you never did, nothing will be released.
Your responsibilities. Choose people you trust. Keep their email addresses current. Respond to check-ins. Use vacation mode when you'll be unreachable.
Our responsibility is limited. We will follow the process above in good faith. To the fullest extent permitted by law, we are not responsible for:
- releases caused by a false, mistaken or malicious confirmation from someone you put on your list, or by a false report of your death;
- messages that are delayed, filtered as spam, or not received;
- outdated contact details;
- information not being released because no one on your list responded;
- what recipients do with information after it is released.
No guarantee of delivery. We work hard to deliver your information, but we cannot guarantee that any message, letter or plan will be delivered, received, read or acted on.
10. Reporting a death
Anyone may report a member's death using our Report a death page. By submitting a report, you confirm that you are acting in good faith and believe the report is true. Knowingly false or harassing reports are prohibited and may be reported to law enforcement. A report only starts the check-in process with the member. It does not grant access to anyone.
11. Acceptable use
You agree not to:
- impersonate anyone or create an account in someone else's name;
- use the Service to harass, threaten or deceive anyone, including through letters or false death reports;
- upload unlawful content, sexual content involving minors, or content that infringes others' rights;
- send spam or add people to your list to send them unwanted messages;
- probe, scrape, reverse-engineer, overload or interfere with the Service or its security;
- use the Service outside the United States or for anyone under 18.
We may remove content or suspend accounts that violate these Terms.
12. Your information, export and deletion
You can download all of your information at any time from Settings → Download my stuff. You can delete your account at any time. We will delete your information within 30 days, except as described in our Privacy Policy (for example, backups that expire within 35 days).
13. Changes to the Service and shutdown
We may change, add or remove features. If we decide to shut down the Service, we will give every user, and every person with released access, at least 90 days' notice and the ability to download their information before deletion. We will not charge for any period after the shutdown date, and we will refund the unused portion of any fees you prepaid for the current year, prorated by day.
14. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms, if required by law, or to protect users or the Service. Where reasonable, we will give notice and a chance to download your information.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY INFORMATION WILL BE DELIVERED OR RELEASED, OR WITHHELD, AT ANY PARTICULAR TIME.
16. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR EMOTIONAL DISTRESS, LOSS OF DATA OR LOSS OF GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, INCLUDING ANY RELEASE, NON-RELEASE OR DELAYED RELEASE OF INFORMATION.
- OUR TOTAL LIABILITY FOR ALL CLAIMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) $50.
Some states don't allow certain limitations, so some of these may not apply to you.
Indemnity. You agree to indemnify and hold us harmless from claims arising from Your Content, your violation of these Terms, or your violation of anyone's rights, including claims by people you added to your list or wrote letters to.
17. Dispute resolution: arbitration and class-action waiver
Informal resolution first. Before filing a claim, contact us at support@imdeadgirl.com and try to resolve it informally for at least 60 days.
Binding arbitration. Any dispute arising from or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by this Section. The Federal Arbitration Act governs this agreement to arbitrate. Either party may instead bring an individual claim in small-claims court, and either party may seek injunctive relief in court for misuse of intellectual property.
How arbitration works. The arbitrator decides all issues except that a court decides questions about the class-action waiver and whether a claim belongs in small-claims court. Hearings take place by video or telephone, or in person in the county where you live. Fees are allocated under the AAA's Consumer Fee Schedule, under which we pay most of the costs of arbitration. The arbitrator may award any individual relief available in court.
Mass arbitration. If 25 or more similar demands are filed against us by or with the help of the same law firm or organization, they will be administered under the AAA's Mass Arbitration Supplementary Rules, and may be resolved in batches, to the extent those rules allow.
Class-action waiver. You and we may bring claims only individually, not as a plaintiff or class member in any class, collective or representative proceeding.
30-day opt-out. You may opt out of this arbitration agreement by emailing support@imdeadgirl.com within 30 days of first accepting these Terms. Include your name, account email, and a clear statement that you opt out of arbitration.
18. Governing law
These Terms are governed by the laws of the State of Michigan and applicable US federal law, without regard to conflict-of-laws rules. Subject to Section 17, any dispute not subject to arbitration will be heard exclusively in the state or federal courts located in Michigan, and you and we consent to their jurisdiction.
19. Changes to these Terms
We may update these Terms. For material changes, we will notify you by email or in the Service at least 30 days before they take effect, and ask you to accept the new Terms before you continue using the Service. The version and effective date are shown at the top.
20. General
These Terms, together with the documents they reference, are the entire agreement between us. If any part is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets, with notice to you.
